What's changed?
Data laws have changed regarding storing or backing up data from the UK to the US.  In a nutshell, the European Court of Justice recently ruled the existing 'Safe Harbour agreement' as no longer valid in the UK - Find out more about this ruling here.

This agreement covered the transfer of confidential personal data to businesses that are members of the US Safe Harbour agreement when using shared servers such as OneDrive, LiveDrive, Google, Dropbox etc.
Does it really affect advisers?
Any advisers using American cloud servers to store or transfer ANY confidential data do need to take action as they could now be breaking DPA with the ICO & FCA.
What do advisers need to do?
The ICO & FCA have recommended that advisers carry out a technical review of how confidential data is treated in their company to ensure this ruling does not affect their regulatory status or security of their confidential data.
The 3 key points to consider are;
  1. Verify where the confidential data is stored
  2. Is the data encrypted at 'Source' or by a 3rd party provider?
  3. Do your existing data storage arrangements now contravene UK data laws?
